1. Does this Privacy statement apply to you?

2. What personal data does Applied Art Forms process and for which purpose?
In the course of its business activities, Applied Art Forms collects and processes personal data. You provide most of your personal data voluntarily to us. In some cases, the personal data is collected automatically by Applied Art Forms or obtained from a third party source.
We do not and will not sell consumer personal information in the traditional and colloquial sense of the word sale. Applied Art Forms processes customers’ personal data to sell its products. As a customer, you also have the option to make use of the following related services: Customer Account: to optimize and simplify your shopping experience, you can create an account on the Website. To create an account, Applied Art Forms needs the following information:

- Account information, including your e-mail address and password.
- Optional information, such as your gender, date of birth and company information; and your preferences, such as your preferred store (if applicable), language, product categories, size and communication methods.

Applied Art Forms Newsletter: Applied Art Forms would like to keep you informed of news relating to Applied Art Forms and send you special offers. If necessary we will ask your consent before sending you our newsletters and offers. To send you our newsletter, Applied Art Forms needs the following information:
- Contact information, including your name, address, e-mail address, age, gender, data of birth, nationality, phone number, social media details;
- Order information, including order history, preference history, products in basket;
- Preferences, including preferred means of communicating with Us, store (location), size, language, etc.;

If you have indicated your preferences in your account, we will tailor our communications, including advertising and marketing, to what we think you will be interested in and provide you with personalized offers. Promotional activity: Applied Art Forms may also organize a promotional activity in which you may participate. To conduct the promotional activity, including for instance to run contests, select a winner and communicate the results, Applied Art Forms may require the following information:

By visiting the Website, Applied Art Forms automatically collects information by means of cookies and similar technologies. This information may consist of:

The major browsers have attempted to implement the draft “Do Not Track” (“DNT”) standard of the World Wide Web Consortium (“W3C”) in their latest releases. As this standard has not been finalized, the Applied Art Forms site is not compatible with DNT. Applied Art Forms uses this personal data for the following purposes:

Newsletter Subscription. When you visit a store operated by Applied Art Forms (if applicable), you may be provided the opportunity to subscribe to our newsletter. When you subscribe, Applied Art Forms may process the following personal data:

3. Who has access to your personal data?
Applied Art Forms may:
- Share your personal data with its affiliates, operating groups, subsidiaries and divisions, if such is necessary for the purposes as listed above.
- Share your personal data with third party vendors and/or service providers for the purposes as listed above. Applied Art Forms will require third parties to conduct activities in a manner consistent with Applied Art Forms policies and guidelines in relation to data protection.
- Share your personal data with parties processing personal data on our behalf. In such cases, these parties may only use your personal data for the purposes described above and only in accordance with our instructions. 6. Does Applied Art Forms collect data of children?
Applied Art Forms does not knowingly collect, use or disclose personal data from anyone under the age of 18. If we determine upon collection that a user is under 18 years of age, we will not use or maintain his/her personal data without a parent/guardian's consent and we will terminate their account. If we become aware that we have unknowingly collected personal data from a child under the age of 18, we will make reasonable efforts to delete such information from our records.

7. What rights can you exercise in relation to your personal data?
Based on the law applicable to the use of your personal data, you may be able to exercise a number of rights in relation to your personal data. Note that in many cases, your rights are not absolute and We may not be required to comply with your request.
a. Your Privacy Choices and Rights
Under the State Privacy Laws, you may have the following rights, including the right to (1) request to know more about the categories and specific pieces of personal information we collect, use, and disclose and access your personal information, including receive the information in a portable format, (2) request deletion of your personal information, (3) request correction of inaccurate personal information, (4) opt out of any “sales” or “shares” of your personal information that may be occurring, including targeted advertising, (5) request to limit the use and disclosure of sensitive personal information, and (6) not be discriminated against for exercising these rights (“Data Subject Requests”).
This section describes consumers’ rights under the State Privacy Laws and explains how you can exercise those rights with Applied Art Forms.
Right of access/Right to know
You have the right to request access to personal data that We have collected and processed about you over the past 12 months. Once we confirm your Data Subject Request, we will disclose to you, upon specific request:
- The categories of personal information we collected about you.
- The categories of sources for the personal information we collected about you.
- Our business or commercial purpose for collecting, disclosing, or sharing that personal information.
- The categories of third parties with whom we disclose that personal information.
- The categories of personal information we disclosed or sold to each category of third party.
- The specific pieces of personal information we collected about you.
Please note that if your access request would require the disclosure of personal data of another individual, we would not be able to comply with all of your access request. Similarly, if responding to your access request would cause Applied Art Forms to violate any law, rule, regulation, or law enforcement request, we would also be unable to fulfill your request.
Right to correction
We take reasonable steps to ensure that the personal data we hold about you is accurate and complete. However, under certain State Privacy Laws, if you believe this is not the case, you can ask Us to update or amend it.
Right of deletion
Under certain State Privacy Laws, you have the right to request that We delete personal data that We collected from you and retained, subject to certain exceptions. Once we receive and verify your Data Subject Requests, we will delete your personal information from our records (and direct our service providers to delete your personal information from their records), unless an exception applies.
We are not required to comply with your request if it is necessary for us or our service provider to maintain your personal data in order to complete the transaction with you, detect security incidences, identify and repair errors, use internally so long as reasonably aligned with your expectations, comply with a legal obligation or otherwise use your personal data internally so long as it is compatible with the context in which you provided it.
Right to opt-out of sale/sharing
State Privacy Laws require that we provide transparency about personal information we “sell,” “share,” or use for targeted advertising, which, under applicable State Privacy Laws broadly means scenarios in which Applied Art Forms has shared personal information with third parties in exchange for valuable consideration. Applied Art Forms “sells” or “shares” personal information for the commercial purpose of placing relevant content and advertisements for you on our own websites and apps, as well as other websites, online media channels, and apps.
Right not to be discriminated for exercising these rights
You have the right to be free of discrimination for exercising your privacy rights. This means that We won’t deny you goods or services, charge different amounts or provide a different quality level of goods or services for exercising your rights unless the difference is reasonably related to the value of your data.
b. How to Exercise Your Rights:
If you are a resident of a state that provides the above rights under State Privacy Laws, you may submit a Data Subject Request by sending an e-mail to help@appliedartforms.com.
Each Data Subject Request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. We will make every effort to verify your identity using your email address, but we may request additional information.
- Describe your Data Subject Request with sufficient detail that allows us to properly evaluate and respond to it.
We cannot respond to your Data Subject Request or provide you with personal information if we are unable to verify your identity, or unable to verify the authority for the person making the request as your agent. We will use personal information provided in a verifiable consumer Data Subject Request to verify your identity or authority to make the Data Subject Request, and not for any other purpose.
You may only make a verifiable Data Subject Request for access or data portability twice within a 12-month period.
In order to opt out of Applied Art Forms’ sale of personal data to a third party click “Do Not Sell My Personal Information” where you will be directed to where you can make that choice.
Authorized Agent
Only you, or a person you have designated in writing as your authorized agent, or who is registered with the applicable Secretary of State to act on your behalf, or to whom you have provided power of attorney pursuant to applicable laws, (“Authorized Agent”), may make a verifiable consumer request to access, port, correct, or delete your personal information. You may also make a verifiable consumer request on behalf of your minor child.
If you wish to have an Authorized Agent make a request on your behalf, they will need to provide us with sufficient written proof that you have designated them as your Authorized Agent, and we will still require you to provide sufficient information to allow us to reasonably verify that you are the person about whom we collected personal information.
c. California Specific Notices
The California Civil Code Section 1798.83 requires any operator of a website to permit its California-resident customers to request and obtain from the operator a list of what personal information the operator disclosed to third parties for direct marketing purposes, for the preceding calendar year; and the addresses and names of such third parties. Applied Art Forms shares personal information collected with third parties for their direct marketing purposes.
We are only required to respond to a customer request for this list once during any calendar year. If you would like to receive a list of categories of personal information disclosed, you may forward your request by sending an e-mail to help@appliedartforms.com. Please be aware that not all information sharing is covered by the California privacy rights requirements and only information sharing that is covered will be included in our response.

We may also notify you via email or other direct electronic communication method of any changes that, in our sole discretion, materially impact treatment of your Personal Information. You are responsible for periodically visiting this Privacy Statement to check for changes. Your continued use of the Program is your acceptance of the Privacy Statement as revised. 10. What about texts?
Applied Art Forms may from time to time offer its customers to sign up for text message alerts from us to receive product and/or event information, promotional offers and more.
- You agree that by providing your mobile phone number you expressly consent to receive automated marketing text messages from us to the mobile phone number provided.
- These messages may use information automatically collected based on your actions while on our sites and may prompt messaging such as cart reminders.
- To the extent you voluntarily opt to have SMS notifications sent directly to your mobile phone, we receive and store the information you provide, including your telephone number or when you read a text message.
- Consent is not required to purchase goods or services.
You can opt out from further text marketing communications at any time by texting "STOP" to our text messages.
